Prosecution case/defense response: Rogers was first sentenced to death in 1989 for luring women into the woods on six occasions, binding, torturing them, and killing them. He also killed two other women for whose deaths he was not convicted. His death sentences were overturned three times by the Oregon Supreme Court. Thus, this was the fourth time that jurors sentenced him to death. In mitigation the defense argued that at age sixty-two Rogers was not likely to cause problems in prison, that he was remorseful and had become religious, and that he had experienced a bizarre childhood during which sex was intertwined with violence.
